How to apply for a fatigue record-keeping exemption permit

Fatigue record keeping is essential for managing driver fatigue, meeting Chain of Responsibility (COR) requirements, and monitoring drivers’ activities. But for some fatigue-regulated heavy vehicle operators, the HVNL record keeping requirements can be very difficult to comply with and maintain. In such cases, operators can apply for a fatigue record-keeping exemption permit.

Preparing your application
Assess
Review your business needs, determine the required flexibility, and then Contact us with your proposal.
Design
Develop an alternative record-keeping arrangement.
Build
Implement the alternative record-keeping approach. Prepare all supporting documents for your application.
Each application must include a copy of your proposed alternative record-keeping arrangements, your accreditation details and a complete list with the names and details of drivers who will be working under the record-keeping exemption if it is granted.
Submitting an application
To submit your application:
- Complete the 'Establish work diary or record-keeping exemption permit form'.
- Determine how long you wish the permit to be for – note that 3 years is the longest timeframe you can request.
- Attach a full list of any drivers who will be using the exemption
- Attach a copy of your accreditation (if required).

After submission
If you are granted a fatigue record-keeping exemption permit, you are exempted from Division 3 of Part 6.4 of the HVNL or parts of this Division that you requested. You must implement your alternative record-keeping arrangements and instruct your drivers who are working under the exemption, on what they must do under those arrangements.
The NHVR may also impose additional conditions above and beyond those you may have proposed as part of your application. These conditions will be included in the fatigue record-keeping exemption permit itself. You must comply with all of these conditions when you use the exemption.
