Drivers and employees
If you are employed as a heavy vehicle driver, you are not a party in the CoR. But it’s important to note that the HVNL includes many other obligations for drivers and other employees in the heavy vehicle industry that you need to comply with.

Drivers must also comply with state transport laws and road rules.
All employees, including employed drivers, also have obligations under work health and safety laws to look after their own health and safety, and that of other employees.

Other people and businesses
Any person or business that uses the services of a heavy vehicle commits an offence if they make a prohibited request or contract with a heavy vehicle driver or a party in the CoR. The maximum penalty for this offence is over $10,000.
A prohibited request or contract is when the person or business knows, or should reasonably know, the request or contract would cause or encourage a heavy vehicle driver to speed or drive while fatigued. (Section 26E)
