Terms of Use
The Freight PASS tool is provided by the National Heavy Vehicle Regulator (NHVR) to assist you in estimating and comparing certain performance indicators of heavy freight vehicle configurations across your defined freight tasks (the Purpose).
In exchange for you accepting and agreeing to comply with the terms herein, the NHVR provides a revocable, non-exclusive, non-transferrable licence to you to access and use only the NHVR Freight PASS tool (Tool) and associated material which includes the outputs of the Tool, the user guide for the Tool and any content in the Tool (Materials), for the Purpose. The licence does not permit you to modify, reproduce, publish, sell, or otherwise commercially exploit the Tool or the Materials.
A reference in these Terms of Use to 'NHVR','we','us'or'our'means the National Heavy Vehicle Regulator ABN 48 557 596 718.
We reserve the right to update or amend these Terms of Use and the NHVR Privacy Policy at any time without prior notice to you. Your use of the Tool or Materials following any such change constitutes your unconditional agreement to comply and be bound by these Terms of Use and the NHVR Privacy Policy as changed. For this reason, you should check this page from time to time to make sure you are aware of any changes.
We may withdraw or cancel your licence to access and use the Tool and/or the Materials at any time. Notification of such withdrawal or cancellation will be published on the NHVR’s website. You acknowledge and agree that publication on our website is sufficient notice for any withdrawal or cancellation referenced in the notice and that you must cease using the Tool and/or the Materials as required by any such notice.
Misuse of Tool
You agree to only use the Tool and Materials in accordance with these terms, its intended purpose and all applicable laws.
Tool Material
As between you and us:
- all of the Materials and the Tool itself is owned or controlled by us; and
- we own all intellectual property rights in the Materials and the Tool, including all copyright, trademarks, design, patents, and other proprietary rights, and any rights to registration of such rights existing anywhere in the world, whether created before or after your acceptance of these terms.
The Materials are distributed by NHVR as an information source only and contains third party data. The basis for use of the third party data is identified in such materials and you will need to comply with those terms. The Materials do not constitute professional, technical, legal, or operational advice from the NHVR and the outputs generated by the Tool do not in any way represent an assessment, determination, endorsement, or recommendation by the NHVR.
We do not guarantee, warrant or make any representations regarding the accuracy, currency, reliability, completeness of, fitness for purpose of, or your right to use the Materials, any other aspect of the Tool, and we accept no responsibility for any errors in the Materials at any time. In particular:
- You are solely responsible for conducting your own investigations and due diligence before making any decisions based on the Tool or Materials.
- You should not rely solely on the Materials without considering the context and seeking your own appropriate professional advice where necessary.
- The Tool is a support tool only, it is not a decision tool and is not intended to replace professional engineering judgment or comprehensive technical assessments.
- The Tool does not influence, imply, direct or determine access rights to road networks. It should not be used as the basis for assumptions about current or future access entitlements.
- The Tool is not part of the Heavy Vehicle National Law (HVNL) and does not replace any legal requirements. It is your responsibility to ensure compliance with the HVNL and other applicable laws.
- The Tool is based on modelling assumptions and methodologies derived from third-party materials. You are responsible for reviewing and adjusting default inputs to ensure they reflect the specific context and conditions of their intended application.
- The inputs and assumptions are subject to change as the tool is updated over time. The NHVR may revise data and assumptions without prior notice to you.
We do not guarantee that use of the Tool or the services available on the Tool will be uninterrupted or error-free, or that Materials will be free from errors, viruses, worms or other harmful codes. We have the right to change or remove any Materials, features or services on the Tool at any time without notice to you.

The Tool may contain links or references to third party sites. We are not responsible or liable for the content of those sites and your access to and use of those sites is at your own risk. Any links are provided for convenience only, and do not indicate any endorsement or recommendation by us.
Disclaimer
To the extent permitted by law, the NHVR make no representations or warranties, express or implied, regarding any matter, including in relation to your use of the Tool or as to the currency, completeness or accuracy of, fitness for purpose of, or your right to use the Materials.
You accept sole responsibility and all risk for using the Tool and for using and relying on any Materials.
You accept that the NHVR shall not be liable for any:
- losses, damages, liabilities, suits and claims suffered by any person in connection with your access or use of (or inability to access or use) the Tool or the Materials, or your access and use of any linked website, regardless of the form of action and the person or entity bringing such action;
- incidental, indirect, special or consequential damages whatsoever (including damages for lost profits, income or savings or interruption of business) that may be suffered or incurred by you or any person or entity affiliated or associated with you.
Indemnity
You indemnify us and hold us harmless from and against (which means that you must meet our costs and expenses, including legal costs on a full indemnity basis, arising from) any loss, damage, cost, expense, claim, proceeding or liability of any kind that we may incur or that may be brought by any person (including you) against us, that arises directly or indirectly from:
- your breach of these terms; or
- your use of the Tool, the Materials or your activities in connection with the Tool.
Termination
We may terminate these terms at any time.
Such termination will be published on the NHVR’s website. You acknowledge and agree that publication on our website is sufficient notice for termination, that any agreement under these terms comes to an end, and that you must cease using the Tool and/or the Materials as required by any such notice.
Privacy
We value your privacy and are committed to protecting your personal information.
In providing access and use of the Tool and Materials to you, and liaising with you about the Tool and Materials, we may collect your name and contact details (e.g., your email address and telephone number). We will use this information for purposes of monitoring uptake of the Tool and Materials, addressing any issues identified in relation to the Tools and Materials (including as may be raised by you with us), looking to improve the Tool and Materials, and to engage with you about your use of the Tool and the Materials (e.g., through surveys or other communications).
Such collection is required in that, if such information is not collected, our ability to monitoring uptake of the Tool and Materials, and otherwise looking to ensure the ongoing integrity of the Tool and Materials, is impeded. Our acknowledge and agree that such collection of personal information is reasonable and you agree to it.
Any personal information collected by us through your access to and use of the Tool and Materials will be collected, stored, used and disclosed in accordance with the Information Privacy Act 2009 (QLD) and NHVR Privacy Policy.
We will only use personal information for the purpose for which it was collected and for purposes which are related to the NHVR’s functions under the Heavy Vehicle National Law.
Governing law
These Terms of Use will be governed by and construed in accordance with the laws in force in Queensland, Australia, and you unconditionally submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
