New South Wales Class 2 Port Botany Container Transportation Authorisation Notice

Operators of Performance Based Standards (PBS) heavy vehicles who operated under the expired New South Wales Class 3 Port Botany Container Transportation Mass Exemption Notice 2019 (No.1) will now operate under a separate Class 2 PBS Authorisation Notice.

These PBS vehicles will operate on the same routes and conditions as they did under the expired Notice but will now be operating under the New South Wales Class 2 Port Botany Container Transportation Authorisation Notice 2024 (No.1).

This ensures that Class 2 PBS vehicles are not provided with a mass exemption under the Notice that could exceed their Vehicle Approval (VA) mass limits. Exceeding their VA mass limits in reliance on the existing Notice could create public safety risks.

PBS vehicles must comply with their VA limits and if there are different limits between the VA and the Authorisation Notice or route limits, then they must comply with the lesser of the restrictions. There is no requirement to carry a copy of the new Class 2 Notice when operating a PBS vehicle, but the Heavy Vehicle National Law (HVNL) requires the driver to carry the VA when operating the vehicle.

The existing Class 3 heavy vehicles will now operate under the replacement New South Wales Class 3 Port Botany Container Transportation Mass Exemption Notice 2024 (No.1), with no changes in conditions or routes.
